  Many people wonder if filing a bankruptcy is the right choice for them.  Most of the time, the questions I hear is, "Do I have enough debt to qualify for bankruptcy?"  My answer, regardless of the amount of money you make or the balances of your debt is the same.  Is your ability to take care of your family's basic needs impacted by your monthly debt payments.  If you cannot put food on the table, it does not matter if your total debt is minimal.

  A Chapter 13 bankruptcy is an individual reorganization.  Debtors who do not qualify for a Chapter 7, either because their household income is too high or they have received a Chapter 7 discharge in the past 8 years pay their disposable income to the Chapter 13 trustee for 3-5 years and then their remaining debt is discharged.  The main other reasons for filing a Chapter 13 is to save a home from foreclosure or deal with back taxes.
  Most people that I meet with are eligible for a Chapter 7 bankruptcy. This is the type of bankruptcy that many individuals are familiar with.  Essentially, Chapter 7 is what I like to call, "a total meltdown".  Your creditors must immediately cease all collections activities against you, including stopping garnishments, repossessions and foreclosures.  A Chapter 7 case can take as little as 90-120 days from beginning to discharge and then your slate is wiped clean.
